MANILA, Philippines – Jollibee Foods Corporation (JFC), which operates the largest fastfood service in the country, Jollibee, has reiterated it has not violated any law and maintained all its workers are regular regardless of how they were hired.

This after the Department of Labor and Employment (DOLE) last April ordered JFC to regularize its more than 7,000 workers including those working for its other franchise.

“JFC is compliant with labor laws and regulations. All of our workers are regular — either through direct hiring or DOLE-licensed service providers,” JFC said in a letter to stock exchange.

“They have security of tenure, proper wages and benefits such as 13th month pay, paid leaves, health insurance and other benefits that they are entitled to under the Labor Code,” it added.

In April, DOLE told JFC to regularize its 6,482 workers employed by Jollibee as well as the 704 others working for Burger King; one of its subsidiary company.

The DOLE directive precedes President Rodrigo Duterte’s signing of an executive order on Labor Day that prohibits ‘illegal contractualization’ although the government has yet to amend the existing labor laws.

In June, JFC chairman Tony Tan Caktiong said during a stockholders’ meeting that contractualization is no longer practiced; not just in the fastfood industry, but in the whole Philippines as well.

“The issue now is about outsourcing. What kind of role can be outsourced or not?” asked Caktiong.

The JFC chairman also said they will appeal the DOLE order even as he maintained that his company “is committed to complying with the law and Department Order 174, which allow contracting arrangements with legitimate service providers”.
